A South Carolina jury has awarded $63.4 million to Michael Perry, who sued Johnson & Johnson (NYSE:JNJ) claiming its Baby Powder caused his mesothelioma. The verdict includes $32.6 million in compensatory damages and $30.7 million in punitive damages. The jury found both J&J and co-defendant American International Industries negligent and liable, determining their actions were "willful, wanton or reckless".

Evidence presented showed J&J knew its talc-based products contained asbestos since 1970 but kept them on the market until 2019. This verdict follows a $260 million asbestos-related verdict against J&J in Oregon earlier this year, marking the fourth jury verdict in favor of Dean Omar Branham Shirley's clients in 2024.

Insights

This verdict represents a significant legal setback for Johnson & Johnson (J&J) in its ongoing talc litigation. The $63.4 million award, including substantial punitive damages, indicates the jury found J&J's conduct particularly egregious. The finding of "willful, wanton or reckless" behavior could have far-reaching implications for future cases. This verdict, combined with the earlier $260 million judgment in Oregon, suggests a trend of large awards against J&J in talc-related cases. The company's failure to warn consumers about asbestos in its products, despite allegedly knowing since 1970, could expose it to significant legal liability. This case may encourage more plaintiffs to pursue litigation, potentially increasing J&J's financial exposure and legal risks.

This verdict could have substantial financial implications for Johnson & Johnson. While the $63.4 million award itself may not significantly impact J&J's bottom line, given its market cap of over $400 billion, the precedent it sets is concerning. With thousands of similar lawsuits pending, this verdict could lead to increased settlement costs or future judgments. The stock market may react negatively to this news, potentially impacting J&J's share price in the short term. Long-term investors should monitor the company's legal reserves and any changes in its financial guidance related to talc litigation. The reputational damage from these cases could also affect consumer trust, potentially impacting sales of J&J's consumer health products.

The link between asbestos exposure and mesothelioma is well-established in medical literature. This case highlights the importance of rigorous safety testing for consumer products, especially those used daily. The alleged presence of asbestos in talc-based products raises serious public health concerns. It's important to note that mesothelioma has a long latency period, often 20-50 years, meaning cases related to historical exposure may continue to emerge. This verdict underscores the need for ongoing research into the long-term health effects of common household products and the importance of transparent communication about potential risks. The medical community will likely continue to closely monitor the outcomes of these cases and their implications for public health policies.

Dean Omar Branham Shirley trial team secures verdict on behalf of man diagnosed with mesothelioma

COLUMBIA, S.C.--(BUSINESS WIRE)-- A South Carolina jury has sided with a cancer patient who sued pharmaceutical giant Johnson & Johnson (NYSE:JNJ) saying use of the company’s iconic Baby Powder caused his lung cancer.

Jurors awarded Michael Perry and his family $32.6 million in compensatory damages and another $30.7 million in punitive damages. Along with Johnson & Johnson, the jury also found co-defendant American International Industries negligent and liable in the case.

Mr. Perry was diagnosed with mesothelioma, a terminal cancer exclusively caused by exposure to asbestos, in July 2023. He used the company’s powder every day because he was allergic to deodorants.

Testimony in the trial showed that Johnson & Johnson knew as early as 1970 that its talc-based products contained asbestos, a known carcinogen, but kept the product on the market, recalling it only after FDA testing in 2019 found asbestos in a sample.

“Neither Michael nor any other consumer should be put in harm's way,” said Dean Omar Branham Shirley (DOBS) partner Ben Adams. “Johnson & Johnson continues to refuse to accept accountability for the lives they’ve taken. But today, the jury saw through their tactics and delivered a measure of justice. And for that, we are deeply grateful.”

Beyond finding the companies liable for Mr. Perry’s mesothelioma, the jury also found clear and convincing evidence that both the actions of J&J and American International actions were “willful, wanton or reckless.”

The trial team was led by Ben Adams along with Rachel Gross and Jonathan George. Attorney Theile McVey of Kassel McVey also represented Mr. Perry and his family.

Earlier this year, the Dean Omar Branham Shirley firm obtained a $260 million asbestos-related verdict in Oregon against Johnson & Johnson. This is the firm’s fourth jury verdict in favor of one of its clients in 2024.

The case is Michael Perry v. American International Industries, et al., case number 2023-CP-40-04072 in South Carolina’s 5th Judicial Circuit Court.
